Transport Agreement

This is our on-line Transport agreement.

This agreement is only to be used as a binding contract between the signing party and Horsepower Unlimited Inc. All paragraphs have an initial space at the end of each and must be accepted along with completion of the information required at the bottom of agreement second page. This agreement is to protect the customer and us from any hidden charges or unseen labor, which comes from any missed or mistaken information.

 

There is a Work Order Number that will be given at the time of Quote which both will need to be written in the required space on this agreement before submitting.  I Agree:

1.Quote: The quote will contain all permit fees, escort fees, ferry fees, and tolls, (some tolls may be added if not listed on permits after transport has been started, but not completed). Quote is good as long as information given is correct.  I Agree:
   
2.Scheduled Times:

We will not stop at any gas stations to let you fill with gas. We will do every thing that we can do, except break any DMV laws to pick up or deliver your boat as to the agreed time, which has been established between customer and us. In the event that a delay does happen we will TRY to notify the customer as soon as possible.  I Agree:  
   
3.Customer is responsible for correct information: If the information given is not correct and leads to a no haul situation the charge for the transport will still apply. If the specifications are different from the ones giving at time of quote and which require a change in permits or an add on escort, you then will be charged for the fees, escorts charges, and our hourly rate of  $75.00 per hour until load conforms to all state DMV laws for transport to continue. If Horsepower Unlimited inc. is at fault, due to us not knowing the requirements of each state and permits have to be changed there will be no charge to you.  I Agree:
   
4. Loading and Un1oading: The customer is responsible for the arrangement of loading and unloading if not discussed at time of quote. If any arise it will be the responsibility of the customer. We will contact the customer if this arises. If a wet load is needed it must be discuss at time of quote. We will not load in salt water and additional fees apply.  I Agree:
   
5. Held Over: If we are held over a reasonable amount of time due to the loading or unloading practice of any marine, marina, or shipping yard the customer is liable for this time at the rate of $75.00 per hour if held over night the flat rate of $220.00 a night. After one complete day we will leave and the full rate will apply unless otherwise requested by customer.  I Agree:
   
6. Trai1ers: If Horsepower Unlimited Inc. uses a trailer that doesn't belong to, or commonly operated by us, it must be owned by the customer which boat is being transported, it will be the customers' responsibility for any and all breakdowns. If a break down was to occur any time spend by our driver will be charged to customer at the rate of $75.00 per hour. Any damage that occurs to the boat due to trailer failure of any type will be the boat owner's responsibility.  I Agree:
   
7.Driver: This is the person that makes all the decision on transporting of your boat. If he sees anything that might not be safe or at any time damage your boat we will contact you to resolve this matter and let you make the decision on what you would like to be done to correct this problem. We take the up most pride in transporting your boat, and will handle it like it was our own. The driver's ability and knowledge is the only one that we go by. If our driver request something to be removed or needs anything to keep it from being a no go situation then that is what must happen. If these request are not meet we will consider it as a no go situation.  I Agree:
   
8.Owner Instructions and Responsibi1ity: This list is to be the customers' responsibility. If any of these tasks are to be done by our driver, YOU WILL BE CHARGED $ 75.00 per hour.
NOTE: If You Do Not Properly Prepare The Boat For Shipping, It Will Be Shipped AS IS. We Will Not Accept Any Responsibi1ity For Any Damage. 

1.  Never give the keys to the driver or leave at the marina for us to pick up. We will not do this.

2.  In some cases the props will have to be removed if so make sure the person who is loading your boat has this capability. This cost will be charged back to you and is the customers' responsibility.
3.  Canvas covers, complete tops including frames, side curtains, rear curtains, anything that may and will blow off or tare must be removed. Shrink-wrapping is transportable as long as it is in good condition. If boat was shrink-wrapped for winter storage it will not stay on during transport. We cannot be responsible for shrink-wrapping staying on or chaffing boat.
4.  Everything in cabin should be sat on floor and anything in cockpit that could and will blowout should be put into cabin and door locked.

5.  If boat or boats are going to be over 13.6 high everything on top of the arch must be removed. (Legal Limit in all states is 13.6 any thing over that requires permits) in some cases the arch itself must be removed. We will not do this, it must be removed or arranged by the customer.

6.  Customer must secure all hatches, portholes, antennas and anything else on deck and outside of boat. If you think it will move or come off it probably will. We will give a quick look to make sure, but not spend a lot of time doing so.

7.  If your bottom paint comes off, the strap wears on old gel coat, if there is a week spot or poorly repaired spot that comes apparent or cracks we cannot be responsible. If your water pump impeller is weak or slightly damage when you restart your engine it will not pump water due to the air-drying them out after transporting.   I Agree:
